High Occupancy Vehicle (HOV) Facilities

Section 1514 “HOV Facilities” of MAP-21 amended Section 166, 23 U.S.C., to clarify some aspects of Federal oversight pertaining to HOVs. In general, Section 166 continues to grant authority to states to operate HOV facilities with some caveats, and provides for non-HOVs in the form of motorcycles, public transportation vehicles, and qualifying single-occupant tolled vehicles (SOVs) to also use the HOV lane. Only for such cases wherein SOV tolled vehicles are allowed, MAP-21 designated requirements for states to monitor the sufficiency of the lane under rules of compliance.
